Terms of Use

1.1. These Terms of Use (“Terms”) govern access to and use of the BeautySync online service (the “Service”) available at   www.beautysync.ai (the “Website”), including all related features, services, and materials.

1.2. The Service is provided by BeautySync Corp., a company incorporated under the laws of the Province of Alberta, Canada. The underlying technology of the Service is currently undergoing patent registration.

1.3. By using the Website and/or purchasing services, the User confirms that they have read, understood, and fully accepted these Terms. If the User does not agree to the Terms, they must immediately stop using the Service.

1.4. These Terms constitute a public offer. Upon acceptance, a legally binding agreement is formed between the User and BeautySync Corp.

2.1. BeautySync provides Users with the ability to receive an AI-powered automated skin analysis based on uploaded photographs. The analysis includes:

• assessment of the condition of the skin on the face, neck, and shoulders (if visible in the photo);
• personalized skincare recommendations;
• creation of a 30-day individualized skincare plan;
• optional purchase of customized skincare boxes.

2.2. The analysis is provided in the form of informational recommendations and does not constitute medical advice, diagnosis, or treatment. BeautySync does not replace consultations with a dermatologist or other medical professionals.

2.3. The Service may offer additional modules (e.g., progress tracking, hair analysis, diet matching, virtual psychologist, etc.) — these are also governed by these Terms unless otherwise specified.

2.4. BeautySync reserves the right to update, modify, or discontinue any part or all of the Service features at any time without prior notice.

3.1. To access the full functionality of the Service, the User may register by providing a valid email address and other required information. Authorization via third-party services (e.g., Google, Apple, etc.) is also available.

3.2. The User must provide accurate and up-to-date information. BeautySync is not responsible for any consequences arising from the submission of false or outdated data.

3.3. Age Restriction: The Service is intended for individuals aged 18 and older. Users under 18 may use the Service only with the consent of a parent or legal guardian. Certain features (e.g., teenage skincare) are adapted for minors, but require adult supervision during use.

3.4. The User is responsible for maintaining the confidentiality of their login credentials and must not share access with third parties.

3.5. BeautySync reserves the right to suspend or delete a User’s account in the following cases:

• violation of these Terms;
• suspected upload of images belonging to others;
• attempts to interfere with the operation of the Service;
• offensive or fraudulent behavior.

4.1. To perform a skin condition analysis, the User uploads four photographs: front, left profile, right profile, and back view. The images must clearly show the face, neck, and shoulders (if uncovered). The photos must meet the following requirements:

• taken in good lighting;
• without makeup or filters;
• without hats or objects obstructing the face or neck.

4.2. The User guarantees that the uploaded photos belong to them personally. Uploading photos of other individuals (including celebrities, avatars, or models) is strictly prohibited and may result in account suspension.

4.3. Uploaded photos are used exclusively for automated analysis, generating recommendations, and tracking progress (if follow-up photos are submitted). Data may be temporarily stored in encrypted form on secure servers for comparison purposes.

4.4. With the User’s consent, images and anonymized analysis results may be used for research or educational purposes to improve the AI and enhance the accuracy of recommendations. This consent is voluntary and may be withdrawn at any time.

4.5. The User has the right to request the deletion of their photos and all related data at any time by submitting a written request via the contact form or to the support email. Deletion will be completed within 7 business days.

4.6. BeautySync applies reasonable data protection measures, including:

• encrypted storage of photos;
• restricted access to images by authorized analysis modules only;
• automatic deletion of inactive records after a set period.

5.1. All materials available on the Website and within the Service — including, but not limited to: analysis algorithms, software code, design, texts, illustrations, graphic elements, and the recommendation system — are the intellectual property of BeautySync Corp. or are used lawfully under license.

5.2. Users are granted a limited, non-exclusive, non-transferable right to use the Service solely for personal, non-commercial purposes and in accordance with these Terms.

5.3. The following actions are prohibited:

• copying, distributing, modifying, or reproducing any part of the Service without written permission from BeautySync Corp.;
• using automated or software tools to access the Service or extract data;
• creating derivative products based on BeautySync’s AI algorithms, recommendations, or interface.

5.4. All user-uploaded photos and data remain the property of the User. However, by uploading photos, the User grants BeautySync Corp. a limited license to use them exclusively for performing the analysis, generating recommendations, and providing related functionalities (e.g., progress tracking, results comparison, technical support).

5.5. BeautySync Corp. does not claim ownership of user images but reserves the right to anonymize and use aggregated data (e.g., statistics on skin types) for scientific, research, and marketing purposes — without the possibility of personal identification.

5.6. The image analysis and recommendation technology used in the BeautySync Service is protected as a trade secret and is undergoing patent registration. The User is informed that this technology is an original development of BeautySync Corp., and any copying, reproduction, or commercial use without permission is strictly prohibited.

6.1. Some features of BeautySync are offered on a paid basis. The current pricing and payment terms are published in the corresponding section of the Website.

6.2. BeautySync offers the following paid products and services:

• One-time skin analysis — $25 per session (4 uploaded photos and personalized recommendations);
• Subscription — $20 per month, includes regular analyses, skincare plans, support chat, and additional features;
• Skincare Boxes — optionally available based on the recommendations. Prices vary depending on the contents (e.g., $100 for Standard, $500 for VIP).

6.3. Payments are made online via the payment systems listed on the Website. All transactions are encrypted and comply with payment security standards.

6.4. Subscriptions are renewed automatically. The User may cancel the subscription at any time through their personal account. After cancellation, the subscription remains valid until the end of the current paid period.

6.5. Refunds:

• One-time analysis is non-refundable once photo processing has begun;
• Subscriptions may be canceled, but the current month's payment is non-refundable if access to recommendations has been granted;
• Skincare Boxes may be canceled before shipment. Refunds after delivery are only possible in the case of manufacturing defects and must be returned in original packaging. Used products are non-refundable.

6.6. In case of payment errors, technical issues, or duplicate charges, the User may contact customer support for resolution and potential refunds.

6.7. BeautySync reserves the right to change prices and the scope of services. All changes take effect upon publication on the Website and do not apply retroactively to already paid periods.

7.1. The BeautySync Service is intended solely for informational and advisory purposes. It is not a medical product and does not provide medical diagnosis, treatment, or therapy.

7.2. The recommendations provided by the Service are based on the analysis of photographs and questionnaire data. BeautySync does not guarantee their absolute accuracy, completeness, or suitability for the User’s individual medical conditions.

7.3. BeautySync is not liable for:

• any skin reactions resulting from the use of recommended products;
• deterioration of skin condition due to incorrect application of recommendations or external factors (e.g., hormonal changes, stress, allergies, etc.);
• errors caused by poor-quality photos (e.g., with makeup, bad lighting, filters, or photos of others).

7.4. The User is fully responsible for their own health and agrees to consult a qualified physician in the presence of chronic skin conditions, acute symptoms, allergic reactions, or other medical issues.

7.5. To the fullest extent permitted by applicable law, BeautySync, its employees, contractors, partners, and suppliers shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of, or inability to use, the Service.

7.6. The total aggregate liability of BeautySync for any claim shall not exceed the actual amount paid by the User for the Service during the most recent month of use.

8.1. Users are prohibited from engaging in any actions that violate these Terms, the rights of third parties, legal norms, or that undermine the operation of the Service.

8.2. Specifically, the following actions are strictly forbidden:

• Uploading photographs of other individuals without their consent, including images of celebrities, models, internet content, or generative images;
• Using the Service fraudulently, such as submitting photos of others as one's own to receive analysis or subscription services;
• Uploading photos with makeup, filters, or visual distortions that affect the quality of the analysis;
• Providing false information during registration or in the questionnaire, including deliberate misrepresentation of age, gender, health conditions, or other data;
• Attempting unauthorized access to the code, algorithms, API, or technical infrastructure of the Service;
• Distributing malware, viruses, scripts, or other elements that may disrupt the platform;
• Using analysis results for commercial or misleading purposes (e.g., presenting the recommendations as professional medical diagnosis);
• Publishing or transmitting materials that contain insults, threats, discrimination, violence, or hate speech.

8.3. If violations are detected, BeautySync reserves the right to:

• suspend or block the User’s account without refund;
• annul the analysis results and cancel the subscription;
• report the User’s actions to the appropriate authorities if they violate the law.

9.1. The User may stop using the Service at any time by deleting their account (if such functionality is available) or by submitting a request to customer support.

9.2. Canceling a subscription does not automatically result in the deletion of the User's account or personal data. To delete all data, a separate request must be submitted via the contact form or support email.

9.3. BeautySync reserves the right to unilaterally restrict, suspend, or terminate a User’s access to the Service without prior notice if:

• the Terms have been violated;
• prohibited content (e.g., third-party photos) has been uploaded;
• there have been attempts to hack, tamper with, or bypass system protections;
• suspicious or fraudulent activity is detected.

9.4. If access is terminated due to a User's violation, any payments made for subscriptions or services will not be refunded.

9.5. If the account is deleted at the User’s request, all associated data (including photos and recommendations) may be permanently deleted upon request. BeautySync reserves the right to retain backup copies for a period defined by its internal security policy (typically up to 30 days).

10.1. BeautySync reserves the right to modify, supplement, or update these Terms of Use and related documents (including the Privacy Policy, Refund Policy, etc.) at any time.

10.2. The updated version of the Terms will be published on the Website with the date of the latest revision. Notifications may also be sent via email or through the Service interface if necessary.

10.3. Continued use of the Service after the publication of updated Terms constitutes the User’s acceptance of the changes. If the User does not agree with the changes, they must stop using the Service and (if desired) delete their account.

10.4. BeautySync recommends regularly reviewing the Terms to stay informed about any updates.

11.1. These Terms and all relations between the User and BeautySync Corp. are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law principles.

11.2. Any disputes, disagreements, or claims related to the use of the Service shall be resolved in the courts located in the jurisdiction of the Province of Alberta, unless otherwise agreed by the parties in writing.

11.3. If any provision of these Terms is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions.
